1. Acceptance
These App Terms of Service (“App Terms”) form a binding agreement between you and BiteMeasure AI App (“BiteMeasure,” “we,” “us,” or “our”) governing your use of the BiteMeasure AI mobile application (the “App”). By downloading, installing, or using the App, you agree to these App Terms, our App Privacy Policy, and our Subscription Terms. If you do not agree, do not use the App.
2. App license
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use the App on devices you own or control, solely for your personal, non-commercial use, subject to these App Terms and the applicable app store rules. You may not copy, modify, distribute, sell, lease, sublicense, or reverse-engineer the App or its AI models except as permitted by law.
3. Eligibility and accounts
You must be at least 13 years old (or the minimum age in your jurisdiction) to use the App. You may register using email/password, Google Sign-In, or Apple Sign-In. You are responsible for your account credentials and all activity under your account.
4. Acceptable use
You agree not to:
- Use the App for any unlawful or fraudulent purpose.
- Upload content that is illegal, infringing, or harmful.
- Attempt to bypass scan limits, security, or subscription controls.
- Reverse-engineer, decompile, scrape, or extract the App’s models or data, except where such restriction is prohibited by law.
- Interfere with or disrupt the App or its supporting infrastructure.
5. Scan limits
The App uses AI food scans, which are allocated based on your plan (for example, a set number of scans during the free trial and per billing cycle for paid plans). Scan allocations, resets, and expiration are described in our Subscription Terms. Attempting to circumvent scan limits may result in suspension.
6. Subscriptions
Certain features require a paid subscription that renews automatically unless canceled. Billing, renewal, scan allocation, cancellation, and restoring purchases are governed by our Subscription Terms and Refund Policy.
7. AI limitations
The App relies on artificial intelligence and image analysis to estimate foods, portions, and nutrition. These outputs are estimates, may be incomplete or inaccurate, and are not guaranteed. You are responsible for reviewing and correcting estimates. See our AI Disclaimer.
8. Not medical advice
The App provides general wellness information only and is not medical, nutritional, or health advice, diagnosis, or treatment. Consult a qualified professional before making health or dietary decisions. See our Health & Nutrition Disclaimer.
9. Your content
You retain ownership of photos, descriptions, and notes you submit. You grant us a limited license to process and store that content to provide the App’s features. You are responsible for what you choose to share with connections and agree not to submit unlawful or infringing content.
10. Suspension and termination
You may stop using the App and delete your account at any time. We may suspend or terminate your access if you violate these App Terms, misuse the App, or create risk or legal exposure. Certain provisions survive termination.
11. Apple App Store additional terms
If you download the App from the Apple App Store, you acknowledge that: these App Terms are between you and BiteMeasure, not Apple; Apple is not responsible for the App or its content; Apple has no obligation to provide maintenance or support; in the event of a failure to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if any), and Apple has no other warranty obligation; Apple is not responsible for addressing claims relating to the App; and Apple and its subsidiaries are third-party beneficiaries of these App Terms and may enforce them. You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. restricted-party list.
12. Google Play additional terms
If you download the App from Google Play, your use is also subject to the Google Play Terms of Service and the Google Play Developer program policies. Google is not a party to these App Terms and is not responsible for the App.
13. Warranty disclaimer
The App is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that estimates will be accurate.
14. Limitation of liability
To the maximum extent permitted by law, BiteMeasure will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for reliance on nutrition estimates. Our total liability for any claim will not exceed the amount you paid for the App in the 12 months before the claim, to the extent permitted by law.
15. Updates and availability
We may release updates, add or remove features, and require you to install updates to keep using the App. We may modify or discontinue the App, in whole or in part, at any time. Availability may vary by device, operating system, region, and store.
16. Governing law
These App Terms are governed by the laws of the State of Illinois, United States, without regard to conflict-of-laws rules, except where the applicable app store terms or your local mandatory consumer law provide otherwise.
