1. Overview
BiteMeasure AI App respects the intellectual property of others and responds to notices of alleged copyright infringement that comply with the U.S. Digital Millennium Copyright Act (“DMCA”). This policy explains how to submit a notice, how to file a counter-notice, and our approach to repeat infringers. Because BiteMeasure allows users to submit and share content (such as meal photos and descriptions), this process helps rights holders report concerns.
2. Filing a copyright infringement notice
If you believe content available through the Service infringes your copyright, send a written notice to our designated agent (below) that includes:
- Your physical or electronic signature.
- Identification of the copyrighted work you claim has been infringed.
- Identification of the material that is claimed to be infringing and information reasonably sufficient to let us locate it.
- Your contact information (address, telephone number, and email).
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.
3. Counter-notice
If you believe your content was removed by mistake or misidentification, you may send a counter-notice to our designated agent that includes:
- Your physical or electronic signature.
- Identification of the material that was removed and its prior location.
- A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court for your district (or, if outside the U.S., any district in which we may be found), and that you will accept service of process from the person who filed the original notice.
We may restore the removed material within 10–14 business days after receiving a valid counter-notice unless the original complainant files a court action.
4. Repeat infringer policy
We may, in appropriate circumstances, disable or terminate the accounts of users who are determined to be repeat infringers.
5. Misrepresentations
Under the DMCA, any person who knowingly materially misrepresents that material is infringing, or was removed by mistake, may be liable for damages. Please ensure your notices are accurate.
